Observation In Jails

On 22 May 2017, at approximately 2:39 pm, I, Officer M. McQuagge was patrolling south on Martin Bluff Rd. I observed a green Mercury Grand Marquis (MS tag JKD104) pass me by with a cracked windshield that obstructed the operator view of the road. I turned around and initiated a traffic stop on Lark Dr and Martin Bluff Rd.

I approached the vehicle on the driver's side and identified the driver as Michael Simmons (DOB 2/23/1974). I explained to Simmons that I initiated a traffic stop for improper equipment. I asked him for his drivers license and proof of insurance and he was not able to provide proof of insurance. While speaking to Simmons, I observed his hands where shaking, he was sweating and was looking around the vehicle. I asked him if there was anything illegal in the vehicle and he stated no. Simmons stated the vehicle belonged to a friend and he came me consent. Dispatch advised me that Simmons had outstanding warrants with the Gautier Police Department and he was detained.

While searching the vehicle, I located a Walmart Deli paper bag on the front passenger seat and it contained three blank Synergy Bank checks (No. 505, 506 & 508) and a Mississippi Identification Card belonging to Jared Lee Stodola (DOB 7/31/1981). The checks belonged to Maureen F. Fanguy of Houma, LA. I also located a Lowe's receipt paid for by check and a Walmart receipt was located by Officer Burkes along with a Synergy check book with beginning No. 621.

After locating the checks and ID card, Simmons stated to me that Maureen gave him the checks to use. He stated he went to Walmart in Pascagoula to get cash and purchase items. He later stated that Stodola used the checks and they purchased items from Lowe's in Gautier. He then dropped Stodola off at the hotel across the street from
