I am writing to you under the provisions of Massachusetts General Law, Chapter 93A, § 9, known as the Consumer Protection Act. As you know, I have attempted to recover my security deposit, paid to you when I began my tenancy at 2 Winchester Place, Apt 5 in Winchester Massachusetts, in June, 2008, through mediation services provided by the Massachusetts Attorney General’s Consumer Protection Division, AGO File# 488305. Cornelio Lozada, a Mediator with the Massachusetts Attorney General’s Office, closed this claim because he felt that a resolution was not possible after speaking with you. Upon closing the claim, he informed me that I may pursue further action by providing you a demand letter, and if there was still no resolution that I may institute legal action in Small Claims Court.

Please be advised that I am demanding the return of my $700 security deposit. I believe that you have failed to comply with M.G.L. Chapter 186 §15B, and the applicable regulations under 940 C.M.R. 3.17, among other violations, including but not limited to the following:

Accordingly, I am hereby demanding the return of my security deposit and payment of statutorily-required interest. Under the provisions of Section 9 Chapter 93A, I am providing you with the opportunity to make a written offer of settlement of this claim within 30 days. If you fail to make a good faith offer of settlement in response to this request, and I institute legal action for this amount, a court may award me double or triple damages, and possibly attorney’s fees and costs, if the court finds in my favor.
