Upon my arrival I made contact with Katie Clark, who was the driver of a 2001 Chrysler Sebring who started stating immediately her friends all told her not to driver. Clark advised me she had drunk a half of fifth of alcohol and that she should not have been driving. While speaking to Clark I could smell a strong odor of alcohol coming from Clark’s breath and she was crying and slurring her speech and stumbling.
I had Clark step to the rear of the vehicle and I conducted Horizontal Gaze and Nystagmus test were I observed all six indicators indicating Clark was over the legal limit.

I conducted the one leg stand test and at first Clark raised her left foot and after putting it down several times she switched and raised her right foot. I observed three of the four indicators.
I then conducted the walk and turn test, during this test I observed five of the eight indicators.
Clark was read implied consent and she agreed to submit to a chemical test of her breath. I observed Clark for the fifteen minute observation period and she provided a breath sample which indicated her blood alcohol content was 0.179.
Clark was advised of the Miranda Warning and informed me of the following:
- She was at her friend’s house on Kinzer Street while at her friend’s house she was drinking vodka.
- She probably drunk about a half of a fifth of vodka.
- She started drinking at approximately 1900 hours and stopped right before she go into the accident.
- She wanted some cigarettes and no one would go get her any so she left.
- All of her friends told her she did not need to be driving.
- She left to get some cigarettes and she did not drive five yards before she hit a parked car.
