The battle for equality is one that has persisted throughout history and many countries around the world seek to have a society that is equal and that continues to promote equality. One of the biggest battles within the scope of equality is the issue of gender inequality. Many societies around the world house gender inequality and this is most apparent in the way that women are treated- they face sexual harassment, gender based violence , their pay is usually less in the workplace and they are also expected to play specific roles within society, usually home maker and child care taker.
Gender inequality in South Africa is prevalent. For example, sexual harassment against women and the rape of women is currently at an all time high but at the same time heavily under reported, according to national crime statistics. Yet, the needs and safety of women are still being neglected as ‘rape culture’ thrives in South Africa today. It places a special emphasis on human rights as well as its three core values: Human dignity, equality and freedom. It seems like an almost perfect document in that it promotes values and protects the rights of people. However, in practice, South Africans still experience major inequality and divide. Karl Klare suggests ‘transformative constitutionalism’ as a remedy to the gaps between theory (the Constitution) and practice (the everyday experience of the South African people).
