To begin discussing this case you must know some of the history and information about the website. First off the name Ashley Madison was not a real person it actually comes from the conjunction of two popular female names “Ashley” and “Madison”. The Website has a slogan which is “Life is short. Have an affair.”. This site is owned by Avid Life Media along with another site called EstablishedMen.com. The site was designed to cater to people that are in relationships but still want to date or to get something out of the relationship from the site that they are not getting fulfilled out of their primary relationship. The first I would like to mention is that this company is advertising to men and women to be unfaithful to their existing partners and have an affair. Another issue that was brought to light when information was released is that they made a “Guarantee” that you will successfully find what you are looking for or they would give your money back. But for this guarantee to be in effect you had to purchase the most expensive package offered, send more costly “priority” messages to 18 individual members per month for a term of at least three months, send at least 5 Ashley Madison purchased gifts per month, and lastly engage in more than 60 minutes of Ashley Madison paid chat per month. The next issue that was uncovered is that the information was analyzed and evaluated that Ashley Madison had approximately 70,000 or more bots sending messages to male users from fake female users. Another analysis performed drew attention that only a small portion approximately 12,000 out of the proposed 5.5 million registered female accounts were actually used on a regular basis. While the company did not admit to but actually eluded to in the terms one clause stated that many profiles were for amusement only. Reportedly one employee in 2012 was requested to create numerous fake female user accounts that would be attractive to the male user group. The first being the security of personally identifiable information. Now in this instance the company itself is not fully responsible for this release but they are indirectly responsible. The hackers are directly responsible for the dissemination of the users personal data but the company could have avoided this incident by shutting down but chose not to which directly constitutes a breach of privacy and security proposed by the company to protect the users information. The next issue is the release of users information that paid the company the fee of $19 to delete their information. The company decided not to delete the users information for some reason from their servers. In this case the company is being paid to provide a service but unknowingly to the users who paid the service was not performed per agreement.
