Common Law Marriage in Texas: What’s Required?
A common law marriage is a marriage that is born as a result of the behavior of a couple. These couples may have never filed for a marriage license or enjoyed a wedding day, yet, in the eyes of the law, they are married. How does common law marriage happen?
In Texas, three elements are required to prove a couple is common law married.
First, the couple must have mutually agreed to be married. One partner cannot claim the couple is married if the other partner has expressed an objection to this relationship.
Next, the couple must have held themselves out as married. Proof often comes in the form of filing joint tax returns, introducing each other as spouses, listing “married” as a Facebook relationship status, and similar behaviors. Even if the couple only represents themselves as married on a single occasion, it may be sufficient to prove common law marriage.
Finally, the couple must have lived together in the state of Texas. Contrary to popular belief, there is no magic number of months or years that a couple must live together to be common law married.
If these elements are met, the couple is married according to Texas law.
