Before the rules became federal, it was up to the states and local governments to impose their own regulations on e-cigarettes. However, some states were more lenient than others. The federal government made the decision to regulate e-cigarettes because state powers/ reserved powers were not being used to secure public health and safety within the e-cigarette trade. As a result, all states will have age and safety regulations on a product that has been lax with public safety. Although some vaping advocates will argue, that public safety is now being abused by the federal government for fear that, stricter regulations will ultimately shut down the vaping industry and push people to continue to smoke more harmful tobacco
