1. I am against the War Powers Act. The act is something that specifically targets a power given to the president through the Constitution. The president needs to be able to quickly react to foreign relations, and if they always have to go through Congress, who are typically slow, than decisions would not be able to get out fast enough. If Congress does not really like the acting president they could refuse to support them and it could be detrimental to our nation.…
In 1967, after ten years of campaigning, a referendum was held to change the Australian Constitution. Two negative references to Aboriginal Australians were removed, giving the Commonwealth the power to legislate for them as a group. This change was seen by many as a recognition of Aboriginal people as full Australian citizens. The referendum campaign effectively focused public attention on the fact that Aboriginal and Torres Strait Islander Australians were second class citizens with all sorts of limitations - legislative and social - on their lives.…
The double majority voting system is hard to achieve, since federation only 8 out of 44 referendums has be successful which was amended in the constitution. One of the most latest referendums which was not successful is the Establish of a republic in 1999. The latest referendum is in 1999 which shows why the australian constitution is also in need of urgent reform since it has not been changed. This would lead to the country not achieving social cohesion, one of the ways to achieve social cohesion is to adapt to the meet changing circumstances and values. Adapting to changing circumstances which is provided by the law mechanism.…
The first written Constitution of United States was the Article of Confederation written in 1777 and ratified by the states four years after. It was helpful for coordinating the War of Independence. After the War for Independence most Americans could feel the weakness of Confederation government because it wasn’t able to regulate and control as it was supposed to do; moreover, the Congress was lacking a secure source of revenue to support new economy. It was very week government, where Congress couldn’t collect taxes, no executive brunch or one national court system were exist, overall it was system lucking any national unity. With the Congress inability to act properly the states themselves started to take action to regulate on their own by imposing high taxes on farmers and other people making them going into debts and eventually all this lead to a famous Shay’s rebellion.…
at the constitution convention, a pre-republic group led by Malcolm turnbull, the current member for Wentworth, Wanted a prominent citizen appointed by parliament as the president. The danger in this is that the power to remove a corrupt government that cannot get taxation bill through the senate for example supply, is obliged to go to the people to either to erected or voted out. If Australians refuse to go to the pole and they run out money then the GG would have to order them in or a president which would be once it is a republic nation. If Australia becomes a republic it will benefit our businesses and the economy.…
Over the years, there have been many debates regarding the constitution. One common debate being whether or not the constitution is flexible enough to live through the generations. Jefferson, a founding father, has stated, “The Constitution belongs to the living and not the dead.” This statement does allude to the longevity of the Constitution, as can be demonstrated through the amendment process, the elastic clause, and judicial review. The amendment process has allowed the United States government to amend the Constitution.…
The preamble outlines the purpose of the constitution, and it describes the powers of the new federal government. The first article defines the three branches of government, the two chamber Congress, and the House of Representatives. It also outlines all the rules and regulations of membership in the House of Representatives. It proclaims that each state will have two senators, gives the House of Representatives the authority to create tax bills, and defines the powers of Congress. The second article establishes an electoral college, provides prerequisites for anyone who wishes to run for president, and outlines the duties and relations between the president and congress.…
This will benefit Australia by giving it independence as country and nation, allowing it to grow on its own, without constantly being under the Queen. Becoming a republic will allow us to have our own head of state, who knows Australia, rather than a queen who lives in a different country. Since the first settlers arrived the Australian people have constantly been growing and forming their own identity, culture, beliefs and values which are different to those of the people in other countries. Australia is already a nation with its own identity, which can only grow stronger if given the chance to become a republic. It is also believed that the ARM 's goal of democratic engagement when choosing the presidential election method is vital if Australia were to become a republic, rather than the 1999 example when people had no choice in this.…
In today’s world the oldest continuing democracy is the United States and the first to hold down the concept of popular sovereignty. Some of the similarities between Australia and the United States is the following: Similarities between Australia and United States They both have Federal and State…
Laws need to be constantly reformed even if the decision only helps out a certain group in the society, as it creates a neighbourly atmosphere in the society. It also allows minority groups to feel self belonging, in a world where many people are trying to abolish same-sex marriage many people can consider Australia a safe zone where they feel accepted which in fact helps cultural diversity and increases the countries tourism. The ‘De Facto’ includes same-sex marriage in 28 different pieces of…
Throughout the drafting of the Constitution, the ideals and philosophy behind the ideas of human rights were twisted and molded to fit the needs of both the northern and southern representatives. Considering the issue of black rights during the 18th century, the dilemma between the 2 sides was balancing on a fair. Taking into account that the north was predominantly antislavery and the south was pro-slavery, without meeting an ultimatum, the Constitution would not for the United States. The southern economy was based off of the revenue the free slave labor provided to them and the boost in a population count. The northern states contrasting with the south refused to take any of these benefits of slavery based off of the people 's ethical beliefs.…
I believe that even though there were positive aspects of the constitution , the government it created was unjust because it greatly limited democracy and protected slavery . There are many reasons why it was unjust. One reason it was unjust was because it was suppose to guarantee citizens rights that were meant to be followed but weren't and citizens not penalized . The constitution had a lot of positive aspects tho , like what it provided .…
In the early days of American history, many of the founding fathers took precautions while writing the Constitution. The reasons these precautions were taken was so that the people of the United States wouldn’t be oppressed because of any amendments or rules. There were many opinions on why/why not the constitution should be supported. However, the Constitution was altered so that we would be truly and undeniably free from oppression. Federalists and anti-federalists have many good and acceptable reasons on their beliefs.…
Australia is said to be a democracy and seen as being about the people, and fair for all. Thus, separation of powers was formed to make sure that this is the case. Separation of powers puts the institutions of government into three different branches. These branches are: The legislature which make the laws; the executive government put laws into action; and the third brach, the judiciary interprets the laws. Separation of Powers is said to be the cornerstone of fair government.…
It is true that the major decision making body in New Zealand’s (NZ’s) government, Cabinet, does operate only under the presence of constitutional conventions. However, this is unique and is the oddest aspect of NZ’s constitution. Thus, it is important to look at the advantages and disadvantages of such a body and how this works in the current political environment of Mixed Member Proportional (MMP) in NZ. Cabinet is a collective group of elected crown ministers headed by the Prime Minister (PM), who meet weekly to decide government policy. Cabinet heads the executive branch of government which executes laws and policies.…
