Abstract
The Americans with Disabilities Act was created and signed into law in 1990. EEOC, Equal Employment Opportunity Commission is responsible for enforcing EEOC laws and being sure Human Resource Offices are aware of all of their rules and regulations. Human Resource Offices are in charge to inform employees of their EEOC Rights. Disability Discrimination falls under over a thousand categories but it can also include harassment because of disability. Victims can be granted awards in a court of lawfor compensatory and punitive damages in addition they may possibly be placed in the job that they were denied because of the discrimination.

There is a one hundred and eight day filing time limit unless your State enforces the same Employment Discrimination which would extend your filing dead line to three hundred days (“United,” 2015). If it is covered under the State and Federal restrictions the suit will automatically be filed with both entities which is known as dual filing. You may file a complaint in person or write your local office to get the legal investigation started. If you write a letter about your complaint be sure and sign it with your signature or it will not be investigated. You must tell why you think you were discriminated against, when and what took place for you to file the suit. EEOC will attempt to resolve through conciliation and if a settlement is not agreed on litigation will follow(Gomez-Meja et al., 2007). Remedies differ because of the unjust action and its outcome on the injured party. You may also be able to recover attorney fees and court costs. The larger the company and the amount of staff can affect the sum of compensatory and punitive damages. Compensatory Damages reimburses you for personal finances you spent for everyday expenditures such as for a job search or medical costs which takes into account of mental suffering also for the distress of the way you were treated.
