Digital evidence is defined as information and data of value to an investigation that is stored on, received or transmitted by an electronic device. Digital evidence can be obtained when electronic devices are seized and secured after a crime. These are the major ones and have different evidence-gathering processes, tools and concerns, and different types of crimes tend to lend themselves to one device or the other.
Electronic crimes (e-crime) such as child pornography and credit card fraud are closely associated with digital evidence. Digital evidence is also used to prosecute many types of crimes, not just e-crime. Suspects' e-mail or mobile phone files might contain critical evidence regarding their intent and their whereabouts at the time of a crime is one example of using digital evidence for prosecuting.
According to the National Institute of Justice (NIJ) in an effort to fight e-crime and to collect relevant digital evidence for all crimes, law enforcement agencies are incorporating the collection and analysis of digital evidence into their infrastructure. Law enforcement analyze digital evidence in three areas: forensic computer, video, and audio analysis.
