Common Sense Principle In The Workplace

Decent Essays
After reading this case, I agree with the ruling. After returning back to work, the employees did not like change. The change will not help him or the employers around him. The best thing to do is to use the “Common Sense Principle” that most companies fail to use after threats. The society is being conscious about situations like this because of a lot of massive warned thought out attacks such as this case. Common sense plays a big role in safety.

According to the Equal Employment Opportunity Commission, it does not protect this employee. Due to the employee giving an imminence of a potential harm against two employers, the federal agency cannot enforce civil rights law against this workplace discrimination.

Alonzo should be compared with Trujillo v. Employment Security Department, 105 N.M. 467, 471–72, 734 P.2d 245, 249–50 (Ct.App.1987), which held that failure to report for overtime work pursuant to an employment contract provision allowing the employer to draft employees in emergency situations constituted misconduct, when the evidence demonstrated that the orders directing employees to report early to work were explicit and not confusing. In Trujillo, unlike Alonzo, failure to comply with the employer’s request was recognized as having significantly affected the employer’s interest. See also Thornton v. Dep’t of Human Resources Dev., 32 Cal. App.3d 180, 107 Cal. Rptr. 892 (1973) (refusal of restaurant employee to shave beard immediately or be terminated was not misconduct when employer failed to show that beard was unsanitary or otherwise detrimental to business); cf.…

An employer's job is to make sure all of their employees are protected and to provide a safe work environment. Janet's employer could have made reasonable accommodations to avoid environmental triggers of seizures such as installing anti-glare filters, reducing the brightness, or a training on how to handle someone who has seizures. Janet's collogues started to avoid her out of fear and lack of their knowledge of epilepsy. The employer should have conducted a training program or send out information on how to take care of someone who is suffering from medical conditions such as seizures right in front of them, without violating Janet's privacy. The lack of sensitivity training towards coworkers lead to the physician who is knowledgeable of epilepsy, to ask the administration to fire her.…

Under Title VII of the Civil Rights Act of 1964, no employer can discriminate against an employee based upon race, color, religion, sex or national origin. When Shaun is demoted by Montgomery ’s it was because the customer (Phil) made a false complaint about her supposedly saying a racial slur towards Phil. Thus under federal law Shaun was not discriminated against because the law only applies to undesirable employer actions against employees based upon Title VII of the Civil Rights Act of 1964 which is race, color, sexual orientation, national origin and so on. Shaun being demoted was not based on those examples; it was based on her alleged behavior.…

Individuals cannot lawfully be denied employment opportunities or have their employment adversely affected merely because of their race, color, religion, sex, or national origin (EEOC Website, 2016).…
