Chris Barker's Case: A Hearing Of Arcadia Insurance

Decent Essays
I attended a hearing in this matter on 07/18/17 before Judge Burke in Hudson, New York. Chris Barker was present for National Interstate Insurance Company and Bill Ryan was present for Arcadia Insurance Company.

This is a controverted case for throat cancer and prima Facie medical evidence has been found. At the last hearing we were ready to take testimony from the claimant and employer lay witness but it was put over to another potential carrier, which was Arcadia.

I called the claimant off for this hearing because it was really just going to be rescheduled once the new carrier was on. Bill Ryan raised all his issues. The Judge suggested his client file a SROI-04 and a pre-hearing conference statement. He continued the case to 10/06/17

The nature of the article is to address the ethical implications of a legal case against the counseling profession by Ward -vs-Wilbanks. Ms. Ward was a graduate student enrolled at EMU in the clinical counseling program during her practicum. During such time, Ms. Ward refused to render services to a client because of her values and religious beliefs; therefore she referred the client to another student. The ACA standard prohibits such practice especially when the counselor’s values are inconsistence with the client’s goals or are discriminatory in nature as this case was. This conflict became evident when Ms. Ward was suspended from the program indefinitely.…

As discussed, I understand that the insurer’s preferred accounting provider was retained to provide their opinion regarding the claimant’s IRB entitlement, however, the insurer’s retention of a professional accountant does not undermine the claimant’s consumer right under SABS s.7(4) to retain their own professional accountant. The funds set aside for this type of report by the insurer is not discounted even if the insurer decides to hire their own third party accounting professionals. The Accounting Report Benefit (ARB) should be regarded as a valuable resource to insurers, as much as for the insured. It is our experience as litigation support specialists that the ARB gives the insured a voice and a central role that they may not have otherwise felt they had. The ARB benefit to insurers is based on the fact that an insurer’s goal, when calculating the IRB, is to achieve the correct calculation at a reasonable cost, with the greatest efficiency.…

When it comes to insurance some may find it a Moral hazard, this is due to it insurance being misunderstood or misrepresented. Since the early 20th century De Beers Corporation has had a monopoly on the world’s diamond supply. This monopoly has essentially enabled them to set the price for diamonds as they made up the largest market share, thus at their peak they controlled up to 80% of the worlds rough diamond supply. Through their tactic of restricting the supply of diamonds, the De Beer Corporation has made diamonds, into a luxury good. Over the past 100 years they have consolidated their vast share of the market through essentially buying out all opposition they faced. Monopolies are illegal because they give a lot of power to an individual supplier giving them an unfair share of market power and price making ability.…
