Our firm represents Jackie Smith, former lessee at the Palace Apartment Complex in Richmond, Virginia. In October 2012, Ms. Smith signed a written lease to rent a unit in the Palace Apartment Complex. Upon signing the lease, Ms. Smith paid a required security deposit in the amount of one month’s rent, or $1200. Ms. Smith rented the apartment for two years and vacated in October 2014 at the end of her lease.

We are requesting the return of Ms. Smith’s security deposit in the amount of $1200. As you are aware, pursuant to § 55-248.15:1 on security deposits, the Virginia Residential Landlord and Tenant Act requires the landlord to return the deposit within 45 days. Ms. Smith has called on multiple occasions asking for the return of her deposit, and you indicated over the phone the funds would be forthcoming. As of the date of this letter, Ms. Smith has not received her $1200, nor has she received written correspondence indicating the reasons for keeping her deposit.

Smith demands the return of her $1200 security deposit in the form of a money order paid to the order of Jackie Smith and mailed to 9000 Lawsuit Lane, Richmond, Virginia 23173. If we do not receive payment by August 1, 2017, we will have no option but to pursue formal legal action in Virginia small claims court.
