Intellectual property is a field of law that has been steadily growing and changing over the years as countless new inventions are patented and protected. Intellectual property is defined as “something that is literally created.” This can be applied in two major ways; that represented by a physical item, such as an invention of “equipment, or machinery”, and that represented by ideas, such as artwork, dance, and literature.
This type of property is protected by patents and copyright, though the age of the internet makes it difficult to completely protect one’s property, and proving that a similar idea or product is infringement is a costly process. Campbell v. Acuff-Rose Music, Inc.
Acuff-Rose Music, Inc. sued the group 2 Live Crew along with their record company because Acuff-Rose believed that 2 Live Crew’s song “Pretty Woman” infringed on Acuff-Rose’s copyright on Roy Orbison’s song “Oh, Pretty Woman.” The district court granted that 2 Live Crew’s song was a parody and therefore under fair use with the original song. The Court of Appeals reversed, stating that the commercial nature of the parody made it unfair.
The case was argued in 1993 and in 1994 the U.S. Supreme Court unanimously decided in favor of Campbell, stating that not all of the elements of fair use were weighed. They found that the Court of Appeals had erred in “applying the presumption of that the commercial nature of the parody rendered it unfair.”

These VPs are expensive and time consuming to make, but provide an invaluable amount of experience to these students. The simplest solution appears to be that these VPs are shared between hospitals, but problems arise as the hospitals don’t own the technology behind the VPs and are not legally able to share it. Intellectual property is one of the hottest subjects in law, and I personally did not realize how much it plays into almost every aspect of life. Items protected include films, literature, and music, and can be seen anywhere and everywhere. Law suits over intellectual property are becoming far more prevalent as people look to protect what they see as ‘theirs.’ I enjoyed researching this as it was both interesting and that I feel it will play into my future
