Captain Rink: None whatsoever.

Robert: Would that be evidence by the fact that he actually received a promotion?

Captain Rink: Yes, absolutely.

Robert: Okay, and again, I know that you said you had no knowledge of the conversation that he alleged that you had with him, but did that conversation play at all into the statement in the FITREP or making my .4 below your average?

Captain Rink: No, not at all, as I said, I think the real crutch of this whole, fitness report and the downgrading of his award, is all based upon the issues that I had with him as performance as laid out in the NIB lock and to me that’s what mattered.

How did reassigning him as a Special Projects Officer, you being his Commander, and he has since been promoted, how did being reassigned at that point, affect his career and where did you memorialize that you had moved him to Special Projects Officer?

Captain Rink: Well, I don’t think it’s specifically laid out anywhere, including in his fitness report, that he was removed from the Hotel Company, indeed. I said look at the FITREP and the fact that he was in Hotel Company and he accomplished X, Y and Z and also as Special Projects Officer, he did this, that and the other. So, I don’t see how a board could see anywhere that I indeed said, I removed him as Company Commander.

In terms of, how did this effect his career and I’m going to go back to what I have stated before, making the move or getting the promotion from O4 to O5, to being a senior officer, it get pretty small at the top there as that promotion pyramid goes up. Clearly, he did not get impacted by this fitness report or anything else along those lines. Metals don’t really impact what boards determine whether you should be promoted or not. What matters is performance, clearly the boards looked at his performance favorably enough to say, and yes we need to promote him up to be a senior

Captain Rink: Yeah, I mean, as I said, I did do a mid-tour discussion with him or mid-tour counseling with him. He certainly saw where there were other areas that he could have done a better job or either communicating to the command issues going on within his command and, sorry, I lost my train of thought there, issues that were going on in his command and also making good judgement calls.

You know, I might have, for example, with the General, the fact that he didn’t even seem to respond to that, didn’t seem to, I want to say the word care, about what I discussed with him in the email, it just all started to kind of add up to the back and forth on the cell phone and such, all just seemed to kind of add up to, it wasn’t just one particular thing, there were multiple things that, if you will, eroded my confidence in his ability to
