The legal environment in the business is very vital in ensuring that business transactions are smoothly effected. Business law entails the local, state and federal laws that govern the creation and daily operations of companies. Both the employees and the employers have a responsibility in ensuring that they abide by the business laws within the business environment. For example, the employees must stick to the agreements in the employment contract and behave in accordance with business ethics. They ought to do duties in a professional manner. The employers, on the other hand, have a duty to ensure that they protect the employee rights such as providing them with a safe working place. This is a legally enforceable contract since it is clear from the terms, and also it is efficient since it is in writing. Ellen gets the contract and agreed to the terms, signed it and sent a copy to Lulene, who had already changed her mind and decided to cancel the contract. She had earlier stated a condition that Ellen was to give her the feedback before 10th, but she decided to cancel the contract on 9th. Ellen, on the other hand, signed the contract and mailed it on 8th hoping to reach Lulene before 10th. By Ellen signing the contract, she closed the deal since she did it before the stipulated time in the contract. However, the contract could be terminated on 9th since it was already in effect from 8th. Supposing Lulene changes the prices of pies to $7 due to the increase in market prices of pies, Ellen cannot sue her for breach of contract even though they had agreed to trade at $5 per pie. This is because Lulene will not have breached the contract since her failure to supply the pies is due to market pressures and not negligence. John ought to have acted professionally in his relationship with Loretta, but he went ahead and tried to assault her sexually. Sexual harassment can be defined as coercion of a sexual nature. It is the act of bullying or unwelcome promise of rewards such as promotions in return for sexual favors. In the scenario, John promised to help Loretta keep her job. Loretta needs to take legal steps to file a case against John for sexual harassment. Loretta needs to review the company code of conduct regarding sexual harassment so as to have a basis for her case. But since she already quit the job, she needs to look for government agencies such as the EEOC who will investigate the claim and once they have sufficient evidence may take the necessary punitive measures against John. The first action involves filing a complaint with the agency that is done in writing and has to be done within required time limits of filing. The second step involves interview of the witnesses by the agency to collect sufficient evidence for the claim. If the agency finds that there is enough evidence about the sexual harassment claims, it makes efforts to settle the case with the offender in an informal manner. If the agency does not reach a conclusive settlement, it may take action of filing a suit on behalf of Loretta.
