Breach Of Confidentiality

Chapter 6 discusses the issues and ethics that come along with Confidentiality. Confidentiality enables the client to the right of privacy. This disables me from disclosing confidential communication to a third party unless mandated or permited to do so (p. 206). In order to conduct effective therapy, one must protect the client communication by maintaining privacy and avoiding the “avoidable” breaches of confidentiality that could potential take place. However, confidentiality does have its limits and issues may arise. One limit of confidentiality that I think I would have difficulty dealing with is HIV positive clients. The required obligation is to warn the intended victim by taking actions to to do so through treatment, contacting the third party or calling the police. In order to protect my client, as well as their sexual partner, from harm I would design a treatment in effort to prevent probable harm from happening and the need to breach confidentiality. Through the construction of treatment stratagies it would enable the client and I to work through risk assessment in by stressing the importance for disclosure to those that they can possibly expose and inform them on the need for preventing exposure. Through risk assessment it also enables me to address to the client the severe criminal and civil liability of the consequences of exposing another, and offer to help in making a disclosure if the client needs support. As a counselor I feel that by informing the client I am guiding them in the ideal path and examining weather the clients threat to do harm to their partner is intentional, and lethal; or if it is a result to feeling ashamed of being infected with the disease.
