Boo Muxley Diary

On 02/23/17 at approximately 0046 hours, Deputy Oxley and I responded to the Dolores Public Library located at 1002 Railroad Ave. in the Town of Dolores in Montezuma County, Colorado. We met with a female identified as Mattingly, Virginia DOB: 03/01/70 who wanted to report a Domestic Violence between her and her boyfriend. Upon arrival, Mattingly, Virginia told Deputy Oxley her and her boyfriend, identified as Mares, Gabriel DOB: 07/25/89, had an argument and it got physical (see Deputy Oxley’s narrative for further information). I had Mattingly, Virginia fill out paperwork while we waited for EMS and the Victim’s Assistant. Once Dolores Fire arrived on scene, they checked Mattingly’s injury and she refused transport to the hospital. Once Robinson, Martha with Victim’s Assistance arrived, I briefed her on the situation and asked her if she was comfortable with us leaving and responding to the residence of occurrence. Robinson stated she was okay with us leaving. Deputy Oxley and I responded to 26185 CR R in Montezuma County, Colorado and talked with Mares, Gabriel. Deputy Oxley grabbed his right arm in an attempt to place him in handcuffs and he pulled away. I grabbed Mares, Gabriel’s left arm in an attempt to assist controlling him. He continued to resist being placed in handcuffs and I placed a knee strike to the muscles of the thigh on his left leg. During the altercation, I got pinned up against a wall. Mares attempted to put me in a head lock.
