There is evidence that detention has an effect on both mental and physical health, as there are incidents of self-harm, suicidal attempt, rape and ill-treatment. This can not only be seen as a failure in fulfilling the government's obligation, but also a breach of international law on human rights, in specific of the International Covenant on Civil and Political Rights (ICCPR) (i.e. refoulement, consideration of the best interest of the child in case of detention for children, etc.) (p18). There have been different arguments about easing the policy and Migration Law, however this raises different perspectives on the matter, which is because of the dangerous current situation of war in countries around the world, and the risks and harm that these asylum seekers an bring to Australia and its citizens.
The significance of this report is to emphasize the importance of the law reformation of Australia's error in its legal system. In short, this report successfully outlines the key matters of this significant issue that Australia is dealing with, and also effectively evaluates the deficiency in the policy that has a side way effect on asylum seekers and Australia.
