Recently, Samsung has been on the news because of their Galaxy 7 smartphone product and its relapsing battery exploding problem. While it may have initially receive a negative appearance to the public and its audience, there is an underlying aspect that goes unnoticed by its critics. The aspect that Samsung is not afraid to test the limits of technology and do it at the costs of sales, public acceptance, or even consumer safety. However, their pursuit for innovation does not mean Samsung does not care about their sales, public appearance, or even consumer safety, but it shows the risks they are willing to make in advancing and achieving their vision of “Inspire the world and Create the Future.” The executives of Samsung realize failure is required in their path to success, and is not afraid of it. Despite this critique, Samsung must obviously be different in some way to be considered a global leader in hardware and software. Samsung can’t be merely taking ideas from companies such as Apple and Google. What they do different is that Samsung implements a strategy called patent circumvention. Patent circumvention focuses on starting from a landscape of patents and claims of an existing patent to create solutions that circumvent this existing patent. An example of Samsung’s use of patent circumvention is their lawsuit with Apple over a keyboard patent dispute. Samsung took Apple’s autocorrect feature and incorporated it in their software arguing that Apple’s original patent refers to hardware and not software technology. While they ultimately lost, and cost them an estimate of $548 million, it shows how Samsung takes patents and tries to loop around and improve it.
